12月23日，拜登签署了“维吾尔强迫劳工预防法案”，该法案引起了中国国内网民的强烈抗议，外交部也抗议美国干涉中国内政。许多美国企业因为执行该法案也受到了谴责，英特尔发声道歉，沃尔玛山姆会员店悄悄将新疆产品下线。对此，CGTN对于山姆会员店的应对进行采访，但山姆会员店没有回应。CGTN还对新疆法案的合理性进行了采访。北京中银律师事务所张逸轩律师受邀接受CGTN Global Business频道采访，就此事件进行解说。

采访内容

美国新疆法案提供了一个“可反驳设定”，这个设定是只要经由新疆生产的产品均被推定为“强制劳工”下生产的，除非企业可以提供“明确且令人信服证据”，而这几乎是不可能的，因为美国政府不会认可无法获得第三方认证的证据。

同时，这个法案在美国也是违宪的。美国宪法第五修正案规定了“无罪推定”的原则，然而新疆法案的设定就是所有产品都是“强制劳工”的产物，这是一种先入为主的“有罪推定”，与美国宪法是相违背的，这个法案不可能在联邦法院的违宪审查中幸存。

新疆法案的执行意味着美国正尝试将新疆从世界供应链中移除，而首当其冲的就是棉花、番茄、多晶硅。因此，这些产业将寻找替代供应，也就意味着价格会上涨。这也会给美国企业带来巨额的成本。

The law creates a "rebuttable presumption" that all goods partially or wholly produced in the Xinjiang region are "tainted by forced labor", unless corporations present with "clear and convincing evidence" that imports from the region are not made with forced labor. In fact, it’s impossible to provide “clear and convincing evidence”, because the U.S. government won’t recognize the evidence not certified by 3-rd party.

Meanwhile, it is unconstitutional in the U.S. as well. The 5th Amendment of the U.S. Constitution provides the principle of “the presumption of innocence”. The law, however, assumes products from Xinjiang are made with forced labor, which is a presumption of guilty in the first place. Therefore, it contradicts the Constitution, and it would have no chance to survive a challenge in federal court.

The enforcement of the law means the US is actually attempting to remove Xinjiang from the global industrial supply chain. Cotton, tomato and polysilicon are on the high-priority sectors of the list. That is to say, the industry has to find alternative supplies and the price would rise up. This would cause huge costs for American companies.
